The terms “We”, “Us”, “Our”, “IN SHAPE”, “IN-SHAPE.com” refer to IN SHAPE Ltd. Corporation. The terms “You”, “Your”, “Yours” and "Customer" refer to the customer using Our Services. The term "Services" refer to Our software, services , Website, IN-SHAPE.com Fitness portal, and mobile applications that we offer.

These “Terms Of Use” are applied to Your usage of our Services, and represent legal agreement between You and Us. You agree that You have read and completely understood our Terms of Use before using Our Services. If You are not agreed with Our Terms and conditions, then you may not use our Services.

We may change or modify our Terms and Conditions in the future. All revision change dates will be listed at the top of the Terms and Conditions page. If accessing our portal periodically, you also agree will you will check this page in order to be aware of any changes to the Terms and Conditions.

As our Services consist of physical activities, there is allways possibility and risk of injury. You agree that usage of Our Services is at your own risk and you take full responsibility for your actions and injuries that can occur. You also agree that We are not responsible if any type of injury occurs .

Using Our Services

Our Sevices offer a Fitness Web/Mobile platform for accessing and consuming professionaly made fitness exercises workouts and training programs . All exercises, workouts and fitness programs are created in cooperation with proffesional Fitness Club IN-SHAPE, and are made of videos, images, and detailed text descriptions. By using our services You agree compliance with all applicable laws, including laws related to copyright and intelectual property use. We are the only owner of the Services and all of its content, includig text, graphics, images, video file, audio files, software and all other intellectual property incorporated in services. You agree that You may not reproduce, copy and distribute any content of Our Services

User information and accounts

Part of Our Services content could be seen and used without need of User registration. Another part of Our Services could be visible to You only if You create Free account. To get full access to Our Services Content, you have to buy a Subscription. In order to buy Subscriptions you need to create a User Account by providing your first name, last name and e-mail address and password. You can login to the User area anytime and change your password. You are responsible for keeping your account secure and safe, and to use it only for personal use. You agree that we are not responsible for any unauthorized transactions made on your account.

Buying subscriptions to access Our Services content

IN SHAPE Ltd. Sell time-based Subscriptions which enable user to get access to Our Services Content (until Subscription expires) and consume exercises, workouts, and training programs.

Cancellation of using Services and Refunds

You can cancel the usage of Our Services at any time. Your subscription to Services usage will stop when it expires. Payments for the Services are non-refundable.

Service Access Termination

We may immediately, without prior notice, suspend or terminate Your use of Services for any reason, with or without cause or warning, and without liability to You for any Services associated with Your account, by termiunating You use of the Services, or by deleting Your account.

Geographic Restrictions

IN SHAPE Ltd. is based in Croatia. We do not claim that the Services or any of its content is appropriate outside of Croatia. Access to the Services may not be legal in certain countries. If You access Our Services from outside Croatia, You use them on Your own and are responsible for compliance with local laws.

Purchase modification

If you have purchase modification requests, you must direct them to IN-SHAPE.com Customer Care Department. Our Customer Care Department will process the request and try to fulfill the request under following conditions:

  • • modification requests could reflect purchased subscription price changes (e.g. if You changed purchased subscription for longer lasting one)

Payment Conditions

Payment is processed in a secure manner by using PayPal's Braintree payment processing company, which supports PayPal and American Express, Visa, Visa Electron, Maestro and MasterCard debit and credit cards.

Braintree is a PayPal's payment processing company that securely handles credit card information. Braintree is a Validated Level 1 PCI DSS Compliant Service Provider.

We do not collect and process your Credit card data. All credit card data is handled and processed by PayPal's Braintree payment processing company. When paying there is no charge or service fee for processing credit or debit card payments.

Currency conversion

All payments will be effected in Euros (EUR). When charging your credit card, the amount displayed on IN-SHAPE.com is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated in our web site. Please contact your bank or card company for any questions regarding applicable conversion costs or fees.

We protect your privacy, the trust of our clients being most important to us.
